On the near horizon of being put into use in Ohio may be the newest line breath testing machines put out by CMI Industries. The new machines are the Intoxylizer 8000 series, which may include a portable model that can be transported in police vans for on the spot complete breath alcohol testing. Yes, this is the same series of breath machines that has already been introduced in some other states, such as Arizona, and which many states have already put a cease and desist order on their future use because of accuracy and reliability concerns. Ohio, however, has never been that concerned with accuracy or reliability when it comes to breath testing. That is why Ohio is only a "one blow" state as compared with the vast majority of state which require two or more breath samples be taken from a person to help insure the reliability and accuracy of the breath reading. A "one blow" state means that the person is generally only given one breath test and whatever number is spit out, its assumed to be accurate - even though there is no second or third test reading to compare it with!
Also coming soon may be "phleboto-cops' - police officers who are also trained phlebotomists and are able to draw a sample of your blood right at the scene following an arrest for OVI or DUI. Other states have also been experimenting with phleboto-cops. This, along with full-fledged transportable breath machines in police vans raise a whole new array of questions and challenges as to the handling, collection, maintenance, officer training, and "environmental" factors that can now potentially affect the reliability of "on the scene" chemical testing for alcohol.
